Release From Jail



The Bexar County Jail releases inmates 24 hours a day.  An individual can be processed as an in & out from the Magistrate’s Office (which basically means it is done in a relatively short period of time).  If a bond is not ready or is not going to be posted the individual will be transported to the main jail for regular processing.

If a judge grants an inmate a Court Ordered Release for that day the inmate will be processed out before midnight.  The jail personnel have to wait for the information to come across from the courthouse.  It is not sent until an hour or two after the end of the business day.  Once at the jail it must be processed before the inmate is released.  The inmate handbook states the time frame for release as being between 4:00 pm and 12:00 am.  However, from what I have been able to find out the time frame seems to be closer to 8:00 pm to 12:00 am for this type of release.

        Ok so I also see that it said 60 days periodic imprisonment but now it says 46 days credit time served how will that go

        Tamera – He will only need to complete 14 more days of time. If by periodic imprisonment they mean work release then the time he is incarcerated will count towards the last amount that is owed.

        I can’t believe our Sheriff holds specials needs people the same as regular criminal’s they can’t answer questions that’s our asked inside the jail with out representation from a well trained staff member or family’s police should focus on hard criminals and thief’s . I plan to contact Acog.

        My husband got 6 months state jail he also received 57 back time he was sentenced on Feb 27 2020. He still has not pulled chain to Dominguez unit.and cause of the CORONA VIRUS Dominiguez unit is not accepting any inmates from BEXAR County jail and he has 20 days left on his 123 day sentence. I’ve call Dominguez .Huntsville.Austin. BEXAR County and no one has a release date on him..Now BEXAR County jail is telling me he will not get released until he goes to Dominguez unit and all this time he’s waiting is deadtime??? Is this true??and his lawyer is no help.. What can I do?? Please help me

        Nicole – Yes, the State facilities are still not accepting inmates from County facilities. We suggest you contact the court clerk for the court his case was heard in. Ask if the judge can be petitioned for additional credit. We recommend you do this once he has hit the full amount of time he was sentenced to and also ask if he can be released as judgment satisfied. That’s the only option outside of dealing with the attorney, that we can think of. There’s no guarantee they will do it but we are under extenuating circumstances with the coronavirus so they might.         Gonzalo – This is an area that I have a lot of problems with. When a judge sentences a person to rehab but the person has to wait until there’s space, they do not get credit for time while they wait. This is commonly referred to as dead time. In my opinion, it’s wrong, but that’s how it’s done. We recommend you speak to her attorney to see when she might be sent.

    I got a call about my husband getting released for the work release program but now I’m calling back to get more information about it their saying he is not on the list. How long does it take for him to get on the list??? And when can I go get him to go to work???

    My husband was ordered to serve a 1 year sentence for a misdemeanor. He has been incarcerated since October 4 2017. Will he be released anytime soon ? And also he was a trustee until he got hurt does that count for some days till his release ? And would he be able to get out sooner than the date indicated.

    Hello. My daughter was sentenced to 6 months. Does anyone know how much she will actually serve? we have a hired attorney but he is telling us she only has a certain amount of days left, but on the kiosk in jail, it says something different. We are just really confused, have never been through this before 🙁

      Christine – We believe they are doing 3 for 1 right now but it may be 2 for 1. What that means is the inmate gets credit for doing 3 days worth of time for every day she is actually there. Or in the second case 2 days worth of time for every day she is there. That doesn’t show up on the kiosk. That privilege can be taken away if an inmate causes problems or gets into any kind of trouble. Only the official time frames are listed in places like the kiosk.

        Is it ok for any law enforcement officer have the right to search 4 times even if u told them. No,…. Then I want to know if you can get arrested 2 months from when the law pulled over my friend n I was in passenger seat and I was told to get someone w lic to drive vehicle cuz driver was going to jail . Yet idk what happen next thing I know th phn is yanked out of my hand I told them what are they doing n I told them they did not have the right to treat me bad plus my face masked was pulled I told them not to take it off they laugh n told me I had other things to worry about. I also told them they could not search me or my bag . They still did what they wanted .

    i have been sentenced to 5 days jail and will start my sentence this friday by 5:00pm. When i was arrested i was booked at 1:00am and i got out at 5:00pm. How much credit for time do you think i will get towards the 5 days/

    My husband was sentenced to a year for a misdemeanor. He got sentence April 17 2018 .he has 64 days credit and has been a trustee since April 18th. I called the jail and they said his projected release date is September 12 ,2018.So how much time will he actually have to serve.

        My was picked up 8pm on a warrant from 10 years ago i posted her bond arond 12:15 when i asked the person i turned her bond too they said it will take 24 hours to be released;how long will it really take?

        John – It used to be pretty efficient. People were released within 4 – 5 hours. But under Sheriff Salazar it seems they are having a lot of problems. We are hearing complaints that it is taking longer than the 24 hours you were told.

    My husband was sentenced to 9 mths on Friday 10/19. He was given credit for 252 days, the judge said he would be going home that day. He was not released so I called the jail and they said he has a GPS hold from his bond and nothing could be done until that hold was removed. I finally got a hold of someone yesterday and they removed the hold. When I called the jail this morning they confirmed that the hold has been removed but they said they have no release info for him yet. Could they be keeping him for the rest of the 9 mths?

    My fiance has been in bexar county jail for 32 days and had 3 days of time served credit. He went in for a 90 day sentence but was offered 2 for 1 and was told he would do 45 days. However they offered him trustee for a total of 3 for 1 making his time 30 days. I cant get any information through the calling center and they wont even allow me to file a complaint . I just want to know what’s going on.

      Nicole – I wish we could give you an answer. Under just about every other sheriff there was pretty much a standard timeline. Sheriff Salazar’s administration has destroyed any kind of normal process. We keep reading how he changed this or he changed that. You have to remember that this is a man doesn’t know anything about running a jail, even three years into running one. All that his changes have done is make the process more confusing, harder to tell what is going on, and easier for the officers to make mistakes. The only answer I can give is vote.

    Hello..I’m writing here today because, my brother is currently in County. He’s been incarcerated since Nov 2019. He was just granted probation (Last Tuesday 3/31) and he still hasn’t been realesed. I’ve already spoken to Central Records multiple times and there are 0 holds on him. I even spoke to a sheriff and he basically said they are waiting for more court documents ???? seriously? A whole week later? I’m just wondering if anyone else has gone through this ? And if so what was the outcome? How long did it take you or your loved one to process out? Would appreciate any advice/feedback . Thank you

      Monica – What we are hearing is that because of the coronavirus hearings are not being held. Without a hearing to either reset the terms of his parole or to send him back to prison, they can’t do anything with him. We don’t know if this information that we were given is accurate. The person we spoke to said “I think…” this is what is happening but it sounds logical. We know the courts are still not having jury trials. It’s possible that they are not having hearings either.

    My son had an arrest warrant served for missing a court date on July 7, 2020. (He remains in jail with a remanded with no bond, waiting for a bed for his transfer to a mental institution. A Psych eval declared him incompetent to stand trial on June 22. The question(s) I have are..Should he still be in jail for missing the court date? An if the reason he still remains in jail is “waiting for bed” who can I call to find out when that will happen. Also in my reading I came across a rule that ordered the “Department of State Health Services,” to transfer individuals who had been ruled incompetent to stand trial due to mental illness, to a state psychiatric hospital wihin 21 days of recieving a judge’s orders. Is this rule still current?

      Ruben – Because of the pandemic, a lot of agencies are not accepting any transfers to their facilities. In addition, Governor Abbott is not allowing counties to release non-violent offenders. This is resulting in all kinds of problems. The jail is filling up at the same time as more and more deputies get infected and are absent from work. We are not attorneys at this website and therefore cannot give legal advice. But we can give an opinion. My opinion on the 21 day rule is that a rule, any rule, can probably be overridden during an emergency and we are definitely in a state of emergency. I Wish I could give you information that would help but I doubt there is much that can be done. Still, I would recommend you speak to your son’s attorney. He or she should be able to give you real information rather than the opinion I am giving you. Good luck to both you and your son.

      Mary – It used to be that jail staff tried to get people out before midnight. Under Salazar, things have definitely slacked off and now with the pandemic, it’s just really hard to tell. Posters have said their people have stayed in up to two days after a judge has signed release paperwork. We have no way to verify that but when you have several people saying a similar thing, you have to wonder. We wish we could give you a better answer but until there is a sheriff who knows what he or she is doing, there will continue to be problems.

    My husband got a technical violation while on parole & his PO said he wanted him to remain in jail til his discharge date which is 9-19-20. On that date he will no longer be on paper. Will he be released on that date like he would if he were in TDC? He has no pending charges…NOTHING. Can they keep him after that date? Actually if he was in TDC instead of county they would release him on Friday the 18th instead of Saturday the 19. I’m just wondering if they will try & hold him longer & say “waiting on parole paperwork”.

      Jeau – The pandemic, and TDCJ’s refusal to take inmates from county jails, has really made things difficult to determine. We’ve heard some rumors about cases like this but we can’t substantiate them so the best we can say is, contact his attorney. Maybe the attorney can get a judge to order his release. As far as when he gets released, if they do decide to release him then he will be released on the scheduled day, which is the 9/19. The Bexar County jail’s intake and release section, like all county jails, is on a 24/7 schedule, not the 8 – 5, M – F schedule that the State is on.

        Nicole – I wish I could agree with you here. It should be against the law, but I doubt it is. It’s probably similar to dead time. Dead time is not against the law and it happens all the time. Dead time is when an individual is being held while waiting to go to whatever facility the sentence decreed but while they wait, they do not get credit for that time. Individuals rarely have much of a chance when standing up against the weight of the government.

    If an inmate is declared incompetent to stand trial and is placed on remanded without bond and is waiting to be transfeed to a mental facility is told the transfer will take 6 months or more. Can this person request to be bonded out during the waiting period or does this person have to sit in jail until the transfer occurs

      Ruben – You can always ask but if someone is in jail for committing a crime and they have been declared incompetent to stand trial, I seriously doubt anyone is going to want to release the person on bond while waiting for space at a mental facility. It’s a matter of liability and public trust. The jail is no place for mentally ill people but unfortunately, our mental health services are not funded to support them properly.

        If the defendant is only doing 9 months. Can they change his time from state jail to Bexar county time. Were the defendant can get 2 for 1 or 3 for 1 instead of day for day.       Fiona, it is a state jail sentence. It doesn’t matter where you serve it at whether it’s Dominguez or in county jail. The virus has shut down the chain transfers but he’s still doing state jail time which is day for day except for the 80/20 law that came into effet sep 1st 2011 I believe. So as long as the offense he was sentenced to happened after that date then he is eligible for the 80/20. That means about 30 days prior to his 80% of his sentence being served they send paperwork to his judge and the judge reviews it and grants or denys the ability to get up to 20% off the sentence. In most cases they are denied from what I have seen but I have seen it be granted but rarely the whole 20%. It doesn’t matter if they do their time in county jail it’s still state jail time they are doing so it’s only eligible for the possibility of 20% off max. No 2for1 or 3for1.

    Who can I call to get information regarding an evaluation by the Center Human and Care Services and my son which happened on Oct 15, 2020. My son had been declared incompetent to stand trial on July 7, 2020 and on Oct 15, 2020 a psychiatrist from the Center re-evaluated my son and according to him, he was informed by the psychiatrist that he was now competent and she would forward the required documentation to update his records, My son can not recall the psychiatrist name and nobody seems to know anything about this meeting.

      Ruben – This is a very tricky area since not only is it medical, but it’s also mental health. Your son’s right to privacy will be strictly enforced and unless you have guardianship over him, you will not be able to get the information. Your best bet is to contact his attorney.

    My fiancee got probation yesterday morning at court (he was RWOB) & thought he’d be out by later the same night. I figured it wasn’t gonna happen but didn’t wanna bust his bubble. I called at midnight & he was still “in jail”. I waited a couple of hours & called at 2:20am & was told he should be out sometime early this morning. So hoping they process people on probation faster than the ones on bail, he should be out by 4-6am. Vinelink said he was released at 2am. So guess I’ll be there waiting for him in about an hour or two provided that’s still an accurate time frame. 🤞

    I have a question. My husband is currently in county, 3 cases dismissed and 1 time served. He is on parole and has still not been released. Could you tell me why? I have tried to contact his parole officer to find out information on a revocation hearing but cannot get through i have left voicemails and I am not getting no responses. I don’t really know what else I could do. Case has been closed and he is still in there.

      Nicole – We are NOT the official Bexar County jail. We are a private website that tries to help people deal with the jail system. Parole is state level. We only deal with Bexar County. I will say that it is probably the case where he served time, that is holding him up. As you said, they are probably waiting on a hearing to decided if his parole is going to be revoked. The whole state system is a mess due to the pandemic. I don’t know what to tell you other than try asking to speak to a supervisor when you call the parole office.

      He has to have a parole hearing. He can waive the hearing or opt to attend the hearing in person. It’s a lot faster to receive an answer if you waive your hearing but who wants to do that? It’s your life, speak on your behalf.

    Look people, if someone you know is sentenced to state jail or even TDCJ, the time the sit waiting to catch “chain” is NOT “deadtime”. These days count. There is only certain cases that “deadtime” comes into play. Like waiting to go to miof or safpf(safe p). Any court ordered rehab/programs while on probation has a wait time before a bed is available. The time ordered to do at a rehab/program by a judge doesn’t start until they arrive at that facility for the program. Time sentenced to do in a state facility like TDCJ or STATE JAIL you get those days that you have served. If any days were not credited they can apply for those days when they get to TDCJ or STATE JAIL. There are cases when certain days don’t count. Like when you are on probation and you violate and get sentenced to safpf(safe p). You complete safpf and are released back on probation and violate again but this time your sentenced to do your time. The days at the program will not count towards back time. The days sitting in county waiting to go to the program will now count as back time since they were done in the county jail. This is different from before when it was referred to as deadtime. It was deadtime because it didn’t count towards the time sentenced to do at a program. It’s now not deadtime because you were sentenced to do your time. But only days served in county and not the days served at a program are granted as backtime. Now I have seen the very very rare occasion the county days weren’t granted as backtime or that the program days were granted as backtime. This is rare. Don’t count on it. And understand that san antonio is the most lenient city I have ever seen or been sentenced in. If you don’t feel something is fair try that same situation and case in Comal county or any of those small cities/counties in texas and see what you would get there. Plus it’s all about you and your case/history and how you present yourself. I have been to state jail and tdcj. I have seen a lot but one thing I know is, don’t go to court with nothing to present the judge on why they should be lenient on you. Show them what you have going for you and explain how and why this was a mistake and what your plan is to correct and prevent the behavior from happening in the future. SELL YOURSELF PEOPLE

    My husband was arrested 12/13/23 for a parole violation (2 years after his parole was supposed to end), I’ve spoken to his parole officer and he told me that there is no need for him to be there and is waiting on his management to sign the letter for his release. I was told once they receive the letter they can begin processing his release. Is there a possibility he can be released on a weekend once they receive the letter?
